These Terms govern your use of our website, scheduling platforms, online forms, and in-person services. By engaging with Malek in any way—online, by phone, or through service visits—you agree to follow these Terms.

 

  1. Use of Our Services

You agree to:

– Use our site and scheduling systems only for lawful purposes.

– Provide accurate contact information, property access details, and system descriptions.

– Not interfere with or disrupt any of our digital tools, scheduling systems, or communication platforms.

– Not use automation, bots, scraping tools, or unauthorized technologies to access our content.

We may remove access or refuse service for misuse.

 

  1. Scheduling, Pricing & Availability

Appointment times are estimates and may vary due to weather, emergencies, or prior jobs. Pricing may change based on diagnostic findings, age, access, code requirements, or seasonal variations. Final pricing is confirmed only after on-site evaluation.

 

  1. Estimates & On-Site Findings

Our techs provide recommendations based on visible and accessible conditions. Estimates may change if hidden issues, safety risks, or code violations are discovered. Declining required repairs may limit warranties or service guarantees.

 

  1. Right to Decline Service

We may refuse or postpone service if:

– Equipment is hazardous or inaccessible.

– Conditions present health or safety risks.

– Work would violate building code or manufacturer requirements.

– Property differs from what was described.

– Requested work falls outside our licensing.

 

  1. Payments

Payment is due at time of service unless financing or arrangements are approved. Third-party processors handle payments securely. Returned payments or chargebacks may incur fees. Unpaid balances may be sent to collections.

 

  1. Memberships, Loyalty Credits & Promotions

– TPP memberships renew automatically unless canceled before renewal.

– Credits cannot be applied toward membership purchases.

– Discounts or promotions cannot be combined unless stated.

– Benefits apply only to active members.

 

  1. Cancellations & Dispatch Fee

You may cancel anytime before dispatch. Once a technician is en route, a dispatch or minimum service fee may apply.

 

  1. Manufacturer Warranties

Manufacturers—not Malek—control warranty approvals, parts availability, reimbursement, and timelines. We assist with processing but cannot override decisions.

 

  1. Communications Consent (Email, Phone, SMS)

By providing contact information, you consent to receive:

– Service updates

– Reminders

– Follow-ups

– Promotions

SMS: Message/data rates may apply. Reply STOP to opt out.

 

  1. Call Recording

Calls to and from Malek may be recorded for scheduling accuracy, training, quality assurance, dispute resolution, and Google LSA lead verification.

 

  1. Intellectual Property

All branding, website content, images, videos, and written materials belong to Malek. Reproduction or redistribution requires written consent.

 

  1. Limitation of Liability

Malek is not liable for:

– Pre-existing issues or unsafe conditions

– Failures due to age, neglect, or lack of maintenance

– Damage caused by third-party work

– Losses from misuse or ignoring recommendations

Your exclusive remedy is the warranty tied to the service performed.

 

  1. Changes to These Terms

We may update these Terms as needed. Updated versions will be posted on our website. Continued use constitutes acceptance.
